Executive Staff Meeting Summary (Revised)
October 25, 2004

Chairman Danielsen called the meeting to order at 9:00 a.m.

Present: Chairman Vernon Danielsen, Commissioner Esther Vassar, Senator Warren Barry, Virginia Adams, Curtis Coleburn, Shawn Walker for Chris Curtis, Becky Gettings, Janet Lawson, Bob Moore, Nancy Murphy, Robert O’Neal, Robert Southall, Craig Vanderland, John Wszelaki, Carla Collins and Sandra Hankins.

Absent: Chris Curtis

The Board approved the October 12, 2004 minutes.

Unfinished Business:
There was no old business to discuss.

New Business:
Commissioner Vassar moved and Senator Barry seconded to approve the following:

  • Approval (for the record) to hire Law Enforcement Manager 1/ASAC, position 00968, Alexandria Enforcement Office-Vernon Danielsen
  • Approval (for the record) to hire Admin & Office Specialist III/Program Support Tech, position 00356, Enforcement Division, - Vernon Danielsen
  • Approval (for the record) to hire consultant (Quality Assurance Manager), 3-month contract to hire, Information Technology Division- Vernon Danielsen
  • Approval (for the record) to Implement Policy Revisions concerning Use of Information Systems, Telecommuting Policy and Implement the Workplace Smoking Policy-Vernon Danielsen

Virginia Adams Requested a decision regarding opening of ABC Stores the Sunday after Christmas and Sunday after New Years. The board unanimously agreed that the "Sunday Stores" not be open on the Sundays after Christmas and New Year's Day.

Upon motion by Senator Barry, seconded by Ms. Vassar, the Board voted 3-0 to adopt the amendments to 3 VAC 5-40, Requirements for Product Approval, as the proposed regulation was published in the Register of Regulations on July 26, 2004.

Upon motion by Senator Barry, seconded by Ms. Vassar, the Board voted 3-0 to adopt the amendments to 3 VAC 5-40 and 3 VAC 5-70, the direct shipping rules, as the proposed regulation was published in the Register of Regulations on August 23, 2004.

Upon motion by Senator Barry, seconded by Mr. Danielsen, the Board voted 3-0 to amend the proposed amendments to 3 VAC 5-30, Tied-House, published in the Register of Regulations on August 23, 2004, by deleting the proposed repeal of the deposit section, 3 VAC 5-30-40.

Upon motion by Senator Barry, seconded by Ms. Vassar, the Board then voted 3-0 to adopt the proposed tied-house revisions as amended.

With no further business to discuss, the meeting adjourned at 10:52 a.m.
